The website https://benoit-jeanmaire.com is the sole property of Benoît Jeanmaire, including all associated rights. Any reproduction, in whole or in part, is subject to prior authorization from the owner.

Article 2: Acceptance of Terms

These Terms and Conditions of Sale (“T&Cs”) apply to all sales made through https://benoit-jeanmaire.com, whether for original artworks available in the online shop or for bespoke commissioned artworks. They form an integral part of the contract between the Buyer and the Seller.

The Seller reserves the right to amend these T&Cs at any time by publishing a new version on the website. The applicable T&Cs are those in force at the time of payment (or the first payment in the case of split payments).

By placing an order, the Customer acknowledges having read and expressly accepted these T&Cs without reservation. These T&Cs shall prevail over any other document unless otherwise expressly agreed in writing.

Article 3: Artworks and Ordering

Benoît Jeanmaire offers two types of creations:

  • Original dry pastel artworks, available for immediate purchase in the online shop.
  • Personalised portraits created from photographs, made to order.

3.1 Original Artworks (Online Shop)

Each artwork is unique. Once sold, it is no longer available.

Framed artworks are shipped only within mainland France and the European Union due to the fragility of framing materials (glass, frame). This restriction is clearly indicated on each product page and enforced at checkout.

Unframed artworks are shipped flat, carefully protected, and may be shipped worldwide.

Each original artwork includes a signed certificate of authenticity containing details of the artwork (title, medium, dimensions, year) and a QR code linking to its product page.

3.2 Commissioned portraits

To commission a portrait:

  1. The Customer contacts the artist
  2. A project discussion takes place
  3. A quote is issued
  4. A 25% non-refundable deposit is required to confirm the order
  5. Production begins only after payment of the deposit or full amount

The artist reserves the right to refuse unsuitable reference photographs. The Customer must hold the rights or authorization for any submitted images.

If reference material requires artistic reinterpretation, the Customer will be informed in advance and acceptance of the commission implies agreement that artistic interpretation may be necessary.

Delivery timelines depend on workload and may vary from a few weeks to several months.

Article 4: Pricing

Prices are stated in euros, net and VAT not applicable (Article 293 B of the French Tax Code).

Shipping is free within mainland France for original artworks. International shipping costs are calculated at checkout.

Custom commissions are priced via individual quotation.

For shipments outside the EU, customs duties and import taxes are the sole responsibility of the Customer.

The Seller reserves the right to modify prices at any time for future orders.

Article 5: Payment

Payments for online shop artworks are processed via Stripe (Visa, Mastercard, American Express, Apple Pay, Google Pay, Link).

Commission payments may be made via PayPal, bank transfer (EU accounts only), or cheque (France only).

In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to custom-made goods.

Article 6: Delivery

Shipments are tracked, insured, and require signature upon delivery.

Risk transfers to the Customer upon physical receipt of the artwork.

Delivery times are indicative. The Seller cannot be held liable for delays caused by carriers, customs, or force majeure.

Article 6 bis: Damage and Loss During Shipping

All artworks are shipped with ad valorem insurance provided by Colissimo, covering the declared value of the artwork in case of loss, theft, or physical damage during transit. Insurance is automatically included with every shipment.

Under Article L.221-15 of the French Consumer Code, the Seller is fully responsible for proper delivery. In case of any issue, Benoît Jeanmaire will directly manage the claims process with Colissimo. The Customer is not required to contact the carrier.

If a package arrives damaged, the Customer must:

  • Note any damage on the delivery receipt before signing
  • Photograph the packaging and artwork before full unpacking, without discarding any materials
  • Contact the Seller within forty-eight (48) hours at benoit.jeanmaire.art@gmail.com, including photos and tracking information

The Seller will file the claim within the legal deadline of three (3) calendar days.

Claims submitted after forty-eight (48) hours or without sufficient evidence may affect eligibility for compensation. Customers are advised to retain all packaging until the case is fully resolved.

In case of loss, the Customer must contact the Seller if tracking shows no movement for six (6) business days in France or thirty (30) days internationally.

Article 7: Right of Withdrawal

7.1 Original Artworks (Online Shop)

The Customer has a 14-day withdrawal period in accordance with Articles L.221-18 et seq. of the French Consumer Code.

Items must be returned in original condition with certificate of authenticity. Return shipping costs are borne by the Customer.

7.2 Custom artworks

In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to personalized goods.

Article 8: Certificate of Authenticity

Each artwork includes a bilingual certificate of authenticity signed by the artist, confirming its uniqueness and detailing its characteristics.

Article 9: Intellectual Property

Purchase of an artwork does not transfer intellectual property rights. The artist retains all reproduction and exploitation rights.

Article 10: Legal Guarantees

Works are covered by legal guarantees against hidden defects (Articles 1641 et seq. of the French Civil Code).

Due to their handmade nature, minor variations are inherent and do not constitute grounds for complaint.

Article 11: Evidence

Digital records of orders and payments are considered valid proof of transactions.

Article 12: Data Protection

Personal data is processed in accordance with GDPR and the French Data Protection Act. Customers may request access, modification, or deletion of their data.

Article 13: Severability

If any clause is deemed invalid, the remaining provisions remain fully effective.

Article 14: Governing Law and Jurisdiction

These Terms and Conditions are governed by French law.

In case of dispute, jurisdiction shall lie with the competent French courts.

The French version of these Terms and Conditions shall prevail in all cases.
